It doesn't seem like it would be right, but I know if she was a juror she would be dismissed. If a judge has a daughter who was raped and murdered, can she take on rape cases?
judges can do anything they want. Then its up to the affected party to spend billions of dollars appealing....
HAHAHAHAHAHIf a judge has a daughter who was raped and murdered, can she take on rape cases?
i see nothing wrong with it...at least when the turd is convicted she won't let the rat off easy.....
too bad there isn't a place in the desert where rapists could be buried up to their necks in anthills with a syrup sundae on top of their heads.........
Y not?
YES OF COURSE, she can take on rape cases. What is the point in disqualifying her to hold a rape case if she is a judge in the first place, I just do not find any wrong with it. Her personal life, concerning her daughter has nothing to do with it.
So if I were a judge and my father is killed by an assassin, so I am not anymore allowed to take on murder cases? But I am a judge, I can handle any cases the court can assigned to me. But if in your question, the judge is hearing the one who murdered and rape her own daughter she should inhibit herself from giving judgement to the case, because she is related to the victim directly. That is the only thing she cannot handle but rape cases she can.
She probably could, but it may not be a good idea. The defense may use that as grounds for judicial disqualification and get a mistrial.
Yes. They would probably have the judge see a shrink and determine if he/she is fit to do this though.
I think it would be more beneficial than having no personal experience at all.
