School project. I am on the anti-censorship side, and the topic I need to cover is legal issues and rights, i.e. First Amendment. Supreme Court cases would support me a lot.
Thanks! Are there any Supreme Court cases about pornography, where they ruled in favor of the distibution and creation?
Sure:
From Wikipedia http://en.wikipedia.org/wiki/Potter_Stew鈥?/a>
To the lay public, [Justice] Stewart may be best known for a quotation, or a fragment thereof, from his opinion in the obscenity case of Jacobellis v. Ohio (1964). Stewart wrote in his short concurrence that ';hard-core pornography'; was hard to define, but that ';I know it when I see it.'; Usually dropped from the quote is the remainder of that sentence, ';and the motion picture involved in this case is not that.'; He later recanted this view in Miller v. California, in which he accepted that his prior view was simply untenable.
Here's a link to the oral argument in a very famous case: http://www.oyez.org/cases/1980-1989/1987鈥?/a>
The Supreme Court's opinion is Hustler v. Falwell 485 U.S. 46 (1988). If you Google that or go to the library you can read the Supreme Court opinion itself. Are there any Supreme Court cases about pornography, where they ruled in favor of the distibution and creation?
wikipedia has a great entry in the matter. I am sure google will find it for you if you search on ';obscenity laws';.
my understanding is that SC has never ruled that porn is illegal to create or to distribute. there have been cases where they have wrestled with the definition of what is or isn't porn, and how distribution may be regulated, but it has never ruled against creating it or distributing it per se
Here's some
